Our service

Festive Portrait creates personalised Christmas portraits and printed products using photographs supplied by you.

The portraits are artistic recreations created with the assistance of image-generation technology. They depict fictional Christmas settings and should not be understood as photographs of events that actually occurred.

Your photos and permissions

You retain your rights in photographs you upload.

By uploading a photograph, you confirm that you have the right to use it and give Festive Portrait permission to process that photograph for the purpose of creating, reviewing, producing and supporting your order.

If a photograph includes another adult, you must have their permission to use their image. If it includes a child, you must be the child's parent or legal guardian or have appropriate permission from their parent or guardian.

Please do not upload photographs that are unlawful, infringe another person's rights or contain content that is abusive, sexually explicit, exploitative or otherwise inappropriate.

We may refuse or cancel an order where uploaded material breaches these requirements.

AI-generated portraits

We work hard to maintain the recognisable appearance of the people shown in your photographs.

However, image-generation technology can introduce variations. Facial details, hair, clothing, body position, backgrounds and other elements may differ from the source photograph.

The finished work is therefore an artistic representation rather than an exact photographic reproduction.

Where a preview or approval stage is provided, you are responsible for checking the portrait before approving it for print.

Ownership of your finished portrait

You may download, save, share and use your finished Festive Portrait artwork for your own personal, non-commercial purposes.

Festive Portrait retains ownership of its website, branding, software, templates, layouts, graphics and other proprietary material used to provide the service.

AI-generated elements may not be unique and similar elements may appear in works generated for other customers.

Orders and payment

Prices displayed on our US store are in US dollars unless otherwise stated.

Applicable taxes and any optional delivery charges will be shown before payment. Payment is taken when you place your order.

Submitting an order does not require us to accept it. We may cancel and refund an order where there is a pricing or technical error, suspected fraud, inability to fulfil the order or another reasonable operational issue.

Changes and cancellations

Our products are personalised and production can begin soon after an order is confirmed.

If you need to change or cancel an order, contact hello@festiveportrait.com immediately.

We will try to help, but once an order has entered production it may no longer be possible to change or cancel it.

Returns and refunds

Because every Festive Portrait product is personalised specifically for you, we do not accept returns or provide refunds simply because you change your mind after production has begun.

This does not affect your rights where a product is faulty, damaged, incorrectly produced or where consumer law otherwise gives you a remedy.

If your order arrives damaged, defective or materially different from the order you approved, contact us within 30 days and include your order number and photographs showing the issue.

Depending on the circumstances, we may replace the affected product, reprint it or provide a refund.

Print variation

Printed products may vary slightly from how they appear on a screen.

Minor differences in colour, crop, brightness, texture and print placement are normal characteristics of physical printing and do not necessarily constitute a defect.

Delivery

Delivery dates are estimates unless we expressly state otherwise.

Festive Portrait is not responsible for delays caused by carriers, weather, customs, incorrect addresses or other circumstances outside our reasonable control, although we will assist in resolving delivery problems where we can.

Liability

To the maximum extent permitted by law, Festive Portrait will not be liable for indirect, incidental or consequential loss arising from use of the service or products.

Where our liability cannot lawfully be excluded, our liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms excludes any consumer guarantee, statutory right or other protection that cannot legally be excluded.

Governing law

These Terms are governed by the laws of [STATE/COUNTRY OF OPERATING COMPANY], without excluding any mandatory consumer protections that apply to you where you live.
